Terms and Conditions of Service

1. The Agreement

These Terms and Conditions (“Agreement”) govern the provision of professional contract shooting and invasive species management services by AusTiger Conservation (“the Provider”) to the client (“the Client”). By engaging our services or accepting a project proposal, the Client agrees to be bound by these terms.

2. Provision of Services

  • Operational Discretion: The Provider will perform services as outlined in the accepted contract. While every effort is made to achieve project objectives, the Client acknowledges that target animals are wild, unpredictable, and do not follow fixed schedules. Consequently, results may vary.

  • Scheduling & Weather: The Provider will endeavour to meet all scheduled service dates. However, the Client acknowledges that factors such as adverse weather, safety concerns, or unforeseen logistical constraints may require the rescheduling of services. Such delays do not constitute a breach of contract.

  • Safety & Compliance: All operations are conducted in accordance with Australian firearms laws, safety regulations, and the Provider’s internal Risk Management Plan. The Provider reserves the right to suspend operations immediately if site conditions become unsafe or if the Client fails to maintain agreed-upon safety boundaries.

3. Client Obligations

  • Site Access & Consent: The Client warrants that they have the legal authority to grant access to the land or premises. Written consent must be provided via an accepted contract prior to the commencement of any works.

  • Information Accuracy: The Client warrants that all identification, property boundaries, and contact details provided are accurate and current.

  • Public Safety: During active control periods, the Client agrees to assist in managing site access (e.g., closing gates or informing staff/residents) as outlined in the Shoot Plan.

4. Fees and Payment

  • Fixed & Variable Costs: Fees are comprised of fixed service rates and variable costs (e.g., ammunition). Variable costs will be finalised and invoiced upon completion of each site visit.

  • Payment Terms: Invoices are strictly payable within 14 days of the invoice date. For multi-visit programs, subsequent visits will not be scheduled until all outstanding balances for previous visits are cleared.

  • Non-Payment: The Provider reserves the right to decline or suspend service if the Client has any overdue invoices.

5. The "Unbeatable Guarantee"

The Provider offers a performance-based guarantee. If the Client is not 100% satisfied with the feral animal control results, the Client may elect to pay the amount they believe reflects the value of the results achieved.

  • Note: This guarantee applies to the service fee and does not exempt the Client from covering pre-agreed hard costs such as travel, ammunition, and planning fees unless otherwise agreed in writing.

6. Media and Privacy

  • Operational Footage: For safety, compliance, and reporting purposes, the Provider may record video or thermal footage of the service.

  • Marketing Use: Unless a Non-Disclosure Agreement (NDA) is in place, the Provider may use de-identified footage for promotional purposes. The Provider warrants that such footage will not reveal the Client’s branding, specific location, or any identifiable markings.

  • Privacy Act: The Provider adheres to the Privacy Act 1988 (Cth). Personal information is collected solely for the delivery of services and will not be disclosed to third parties except as required by law.

7. Termination

  • Notice Period: Either party may terminate this Agreement by providing one month’s written notice.

  • Immediate Termination: The Provider may terminate this Agreement immediately and without notice if the Client breaches any safety protocol, misuses the service, or fails to meet payment obligations.

  • Discounted Packages: Where a multi-visit maintenance discount has been applied, cancellation of the package mid-term will not result in a refund or credit for remaining visits.

8. Liability and Indemnity

The Provider maintains a $20,000,000 Public Liability Insurance policy. However, the Provider is not liable for any indirect or consequential loss arising from the presence of pest animals or the timing of their removal.

9. Governing Law

This Agreement is governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
